ATP Responds to Department of Education "Dear Colleague Letter"  Addressing the Regulation of Third-Party Service Providers

ATP members working in higher education were stunned in early February to receive a 60+ page "Dear Colleague" letter addressing guidance on the regulation of third-party servicers (TPSs) that reflected a major departure from regulations originally adopted in 2016.  Higher education institutions would be required to report to DOE all agreements with TPSs within 10 days of a contract.

Update on U.S. & International Privacy Laws

ATP's General Counsel Alan Thiemann reported that there has been no movement on Federal privacy legislation, although a bill has been introduced related to financial data privacy that is garnering a great deal of interest. Thiemann cautioned that the bill could signal more interest in a consumer privacy approach. "But," he added, "unless a federal law preempts state law it's of no value to any business; any such federal law would only be the baseline for states to build on top of."

ATP at Odds With the National Institute of Standards and Technology

ATP's General Counsel Alan Thiemann shared ongoing concerns with the ATP Board of Directors concerning the Artificial Intelligence Risk Management Framework (“AIRMF”) released January 26, 2023, by the National Institute of Standards and Technology (NIST) and which contains voluntary guidelines for developers and users of AI. Thiemann provided a memorandum that compares the AI RMF with the comments submitted to NIST from the Association of Test Publishers (“ATP”) on the proposed AI RMF on March 17, 2022, and whether and to what extent key ATP recommendations were adopted.

The second part of ATP's Summer Summit Series will be ATP's virtual Global Security Summit*, scheduled for August 22 - 23, 2023.

ATP Honors its 2023 Award Winners

ATP honored its three 2023 Award Winners at the opening session of the Innovations Conference held March  12- 15, in Dallas, Texas. This year's winners included Ada Woo, VP of Innovative Learning Sciences, Ascend Learning, (pictured left with 2023 Conference Chair Ashok Sarathy of GMAC, and 2023 Innovations Conference Chair, Isabelle Gothier of PSI.) Dr. Woo received the ATP Award for Professional Contributions and Service to testing.
